You, the Jury
Internet Exercises
|
In this exercise, you will be asked to look at a case that is not in your text and write an analysis of it using the IRAC (issue, rule, application, conclusion) method. The case features a man who sued a tire manufacturer, claiming that a fatal accident was caused by a defective tire. This case went to the Supreme Court because of the controversy surrounding the concept of "expert witnesses."
For an overview of the case, read "Trial Judges Told to Screen Experts" by Joan Biskupic of The Washington Post. For more background material visit FindLaw's Web site and read the U.S. 11th Circuit Court of Appeals opinion on CARMICHAEL v SAMYANG TIRE for the lower court's ruling on the case. Finally, on FindLaw's Web site, read the Supreme Court decision in KUMHO TIRE CO., LTD., et al. v. CARMICHAEL et al.
