ORDINANCE 151

AN ORDINANCE OF THE COUNCIL OF THE CITY OF PORTLAND ADDING CHAPTER 23.4 TO THE MUNICIPAL CODE OF THE CITY OF PORTLAND. THIS ORDINANCE REGULATES THE USE OF PUBLIC SPACE FOR THE USE OF ALL CITIZENS AND BUSINESSES.

The Council of the City of Portland do ordain as follows:

Section I. Amendment of Article XII.

Article XII of the Municipal Code of the City of Portland is hereby amended by adding Chapter 23.4, which reads as follows:

Chapter 23.4
UNLAWFUL LOITERING ORDINANCE

PURPOSE
The purpose of the ordinance is to maintain public streets and areas within the City in a clean, safe, and accessible condition for residents and the public at large.

UNLAWFUL LOITERING
It shall be unlawful for any person to loiter, to sit, or to lie in the right of way of other citizens in a manner that would hinder their unobstructed passage. Unless otherwise provided, this ordinance will apply to these areas:

  1. Any sidewalk
  2. Any street
  3. Any parking lot, public area or open spaces, improved or unimproved

EXCEPTION
Except as otherwise provided for herein, and upon a showing of necessity, a person may sleep in a vehicle in a parking lot, provided that they own this vehicle, that the vehicle is otherwise legally parked and registered, and that the vehicle stays within the City limits for not more than 72 hours in any 3-month period without being in violation of this ordinance.

ENFORCEMENT
Any person, persons, firm, or corporation who violates the provision of this code shall be guilty of an infraction for each day such violation continues. Authorities may first issue a warning to said violators, with an advisory that said violators must leave the stipulated areas. If said violators, once warned, fail to remove themselves according to the authorities’ instructions, then said violators will be issued a citation pursuant to the penalties set forth in section 23.01 of this Code. In such an event, violators may also be removed to an appropriate institution or shelter, according to the authorities’ best judgement.
